Menu bar does not appear ONLY when workbbok activated via a menu sheet

Hi
I have a menu added to a workbook to simplify alerts, it works perfecty except for when the workbook is opened via a menu created in another workbook. It does not seem to be that excel is already open as I have opened the workbook when other workbooks are already open, and the menu appears and disappears at closing as it should. Is it the menu workbook which is restricting it from opening (cannot attatch).

Any help appreciated as I have used this menu system to other files I wish to upgrade BUT they will all have to be activated through the menu workbook as it is the main console.
