send csv to server

Hi,
I have the following code which saves a csv file to the server when the file is saved. On save a message box asks the user if they want to save it as a csv to the server. For some reason when you select 'No' and there is a file on the server the file will not be sent. If you select 'No' and there is no file on the server it will save a csv file with no data (0k size). Can someone point me in the right direction as to why this is happening?
