a way to know the cell above is neither empty nor overlapped from previous cell?

I have a problem to format in excel using VBA. I need to shift the contents up if the above cells are empty or the cells are not overlapped with the contents from previous cells. I was able to shift the contents up but it does not take care of checking if the above cells are being overlapped with contents from previous cells.

Attached is the test workbook with macro that I could work on so far. Any help is much appreciated.
