Help with Condition based formating

my issue is i have a "list", in it i wish to have condition based formating, but whenever i expand the list, the conditionbased formating dosent "grow" with the list.

thanks in advance guys!

im on excel 2003, i tried this on 2010 and it worked.

but i need this to work in 2003 :/

The CF rule is for the table, check whether the table expand as the data expand ?

the table does expand but becouse its 2003, i need to click "inside of the list", then a "dropdown row" will appear within, if i then type into the newly added row the table does expand, but the Conditional formating (CF) does not
